Fire Protection and Prevention Act, 1997


To the attention of all insurance companies licensed to
transact fire insurance in Ontario and licensed adjusters

The Fire Protection and Prevention Act, 1997 - Bill 84 was proclaimed into effect on October 29, 1997. Under Bill 84 the provision under section 9 of the Fire Marshals Act that required insurers and adjusters to report all fire losses on insured property to the Fire Marshal has been repealed.

Section 88.(1) (f) of Bill 84 authorizes the Solicitor General and Minister of Correctional Services to make regulations requiring the following persons or entities to report to the Fire Marshal the particulars of any insurance loss or claim:

  1. a fire insurance company authorized to transact business in Ontario,
  2. a person adjusting a claim against a fire insurance company, whether the insurance company is licensed to transact business in Ontario or not and whether the adjuster represents the company or the claimant, or
  3. a person sustaining or claiming to have sustained a loss by fire on property insured wholly or partially by an insurance company that is not licensed or registered under the Insurance Act.

Insurers and adjusters will be advised of the new reporting requirements when a regulation has been made.
