Revised assessment guidelines and fee structure for Residual Earning Capacity Designated Assessment Centres


To the attention of all insurance companies licensed
to transact automobile insurance in Ontario

The Financial Services Commission of Ontario (FSCO) is providing, for your information, revised assessment guidelines (guidelines) and a revised fee structure applicable to Ontario’s Residual Earning Capacity Designated Assessment Centres (REC DACs).

The revised assessment guidelines and fee structure, which are effective July 30, 1999, are consistent with the Statutory Accident Benefits Schedule for Accidents occurring on or after January 1, 1994 and before November 1, 1996. The revised fee structure provides for both a flat fee of $6,600 to replace the pre-existing $5,000 fee cap as well as reduced fee amounts for earlier exit points during the assessment process. As a result of these revisions, overall assessment costs will likely remain at current levels.

The revised assessment guidelines are contained in the attached document entitled Residual Earning Capacity Designated Assessment Centres Guidelines: A Guide to Conducting REC-DAC Assessments (guidelines), dated July,1999. This manual replaces Ontario Insurance Commission Guidelines for Designated Assessment Centres to Conduct Residual Earning Capacity Assessments, dated November, 1996. The revised fee schedule is entitled Revised Fee Schedule for Assessments Conducted by Residual Earning Capacity Designated Assessment Centres, dated July 1999.

The Minister’s Committee on the DAC System, whose mandate is to oversee the DAC system to assist DACs in providing neutral, fair, timely and cost-effective assessments, has recommended the implementation of the revised assessment guidelines and the revised fee structure.
