Changes to Statutory Accident Benefits Schedule and Revised Form 1


To the attention of all insurance companies licensed
to transact automobile insurance in Ontario

With this Bulletin, the Financial Services Commission of Ontario (FSCO) is highlighting a change in the Statutory Accident Benefits Schedule – Accidents on or after November 1, 1996 (SABS) that provides for a revised Assessment of Attendant Care Needs (Form 1) for accidents occurring on or after March 31, 2008.

Assessment of Attendant Care Needs (Form 1)

Ontario Regulation 63/08, filed on March 26, 2008, amends Section 39 of the SABS.  The revised Form 1 increases the hourly rate applied to the level 2 attendant care for basic supervisory functions from $8.00 per hour to $8.75 per hour.  This increase is consistent with the increase in the general Ontario minimum wage effective on March 31, 2008. 

For accidents occurring prior to March 31, 2008, the rates set out in previous versions of Form 1 will apply, according to the date of the accident and section 39 of the SABS. 

Copies of Form and Regulation

The revised Form 1, dated March 1, 2008, will be effective for automobile accidents occurring on or after March 31, 2008.  The revised Form 1 is posted on FSCO’s website at www.fsco.gov.on.ca

Ontario Regulation 63/08 will be published in a future edition of the Ontario Gazette and can be downloaded from the Ontario e-laws website at www.e-laws.gov.on.ca
